Spike and Savage Flawsuits

Celebrity lawsuits provide more in the way of comedic relief than case law substance

So, let me get this straight – Spike Lee has sued Viacom because of the proposed name change of “TNN” to “Spike TV?” Spike, Spike, Spike – what have you been "spiking" your Gatorade with?

Apparently, Spike feels that the name “Spike TV” is too closely related to his own good name, and that Viacom is trying to cash-in on his “popularity” for the name change.

No, what Viacom is doing is coming up with a sufficiently masculine name for the first “Network for Men.” Spike's claims that Viacom is trying to cash-in on the viewer thinking of him right away is like saying that Joss Whedon wanted people to think of him when he introduced a Vampire named Spike. You know who I'm talking about. The tall, muscular pasty-skinned Englishman with bleached-blond hair – on “Buffy the Vampire Slayer.”

Now, if "Spike TV" was promoting itself as the first network for people who think "Whitey is Bad!" or complaining that, "The Motion Picture Academy won’t give us any awards because they’re racist,” Spike might have a point. But in the "Real World" (used with permission of MTV), Spike doesn't.

Someone who in my book is more despicable than Spike Lee is Michael Weiner - PhD, better known as Michael Savage. I’m not going to get too deeply into everything Savage says (with a few notable exceptions), but why I think TRN's lawsuit against three small-time websites is a waste of the legal system's time and money.

The most ridiculous thing about this lawsuit is that it claims the domain name “michaelsavagesucks.com” and "savagestupidity.com" are too similar to “michaelsavage.com” and might confuse people. Are these idiots serious? Are there thousands of people out there who would think that an egomaniac (better strike that before we get sued – Ed.) like Savage would put the word "sucks" in his own domain name? Would the Broccoli Council of America use “broccolisucks.com” as a domain name? Hell no! And if Savage thinks his listeners would be stupid enough to put the word “sucks” to try to get to his website, he's got bigger fish to fry than the defendants!

The second thing that has me laughing about this lawsuit is that TRN claims that by urging a boycott of his show, the defendants are causing TRN and Michael Savage financial losses, and creating a hostile business environment. But Savage undoes TRN's claim after ranting on the air that the boycotts haven’t cost him either “one cent, [or] one station."

Boycotts have always been (and hopefully always will be) a valid form of expression protected by the First Amendment. TRN and Savage claims that the three websites are lying about him in their boycott efforts; and while that would be illegal (or should be), he has yet to provide any evidence of these lies. In fact, the majority of what these sites (who’s domain names won’t be published here for fear of a lawsuit – Ed.) use as examples of Savage’s alleged racist, sexist, and homophobic bias are clips from his show, or blurbs from print interviews, straight from his mouth. His mouth! Has Savage lied himself in order to create a hostile business environment?

For the lawyers at TRN, could comments such as this one present your client in the most favorable light? “I'm beginning to think that women should be denied the vote. Their hormones rage; they are too emotional," as quoted in the San Jose Mercury News, Nov. 6, 1998.

Or perhaps this little gem, "The nation is being taken over by the freaks, the cripples, the perverts, and the mental defectives,” rather that activities of the defendants themselves that are driving companies like Culligan away? Could these little nuggets be the reason high profile corporations don’t wish to sponsor Savage’s show? Savage most definitely has the right to say what he wants to so long as it isn’t criminal, but both he and TRN should be prepared to lose sponsors, especially large corporations – when his words are consistently so inflammatory.

The thing that really chafes my ample posterior about this lawsuit is the fact that while Savage rants on and on about his own First Amendment rights to say whatever he wants on the air, he conveniently ignores the First Amendment rights of the people who criticize him.

How tragic, that the self-appointed savior of this country may be nothing but a whiny little piss-ant of a blowhard. Oh, and a disgusting human being, as evidenced by these on-air comments, "With the population that has emerged, since they [Hispanics] breed like rabbits, in many cases the whites will become a minority in their own nation.... the white people don't breed as often for whatever reason. I guess many homosexuals are involved. That is also part of the grand plan, to push homosexuality to cut down on the white race."

Oh, how touching, Dr. Weiner. The whites will become a minority in "their own nation"? Is that one of your genuine concerns? Would you have expressed similar concerns when the American Natives were becoming a minority in their own land? Or was this land merely a “turd-world country” (Savage’s favorite slang for poor, non-white countries) before the invasion of the Europeans? And thank you for pointing out that homosexuals and Mexicans are conspiring to destroy the white race. I had no idea!

Michael Savage's website promoted this product as a way "to show your support our troops in the Middle East":

SUPPORT OUR TROOPS!

As Our Troops are facing the enemy, you can show your support for our Brave Men and Women by getting a Savage Nation Cap for yourself and friends! When you wear your Savage Nation Cap or give them as gifts, you will show your pride in our troops!

So, let me get this straight – the Savage Nation baseball cap with absolutely no mention of our armed forces is a good way to express pride and support of our troops? How, Michael?

Michael Savage, host of The Savage Nation, then out did himself by saying that if he were going to write a book about what happened to Elizabeth Smart that his title would be, "Lizzie Does Utah"!

Or this quote, "If I were making a newspaper up today, listen to me, and I had an afternoon edition-- And the reader's already bought the morning newspaper, they listened to the radio, they saw the TV, why would they buy my afternoon newspaper unless I caught their eye? The headline is "Snow White Raped by Bum in White Robes!" You're going to read that article! --Which you're doing!"

So is Savage saying that it’s okay to ridicule this poor girl's ordeals to sell his damn newspaper? He goes on to say that her family has no right to hide from us the fact that she was raped. Tell me something, jackass! Why is it your damned right to know? You disgust me!

I guess the program's content and topics explains why he goes by the name of Michael "Savage", and not by his birth name of "Weiner". His more controversial topics, "Protection of American (meaning white) Culture", "Keeping Non-White Immigrants Out of Our Country", "Let’s Nuke China" and "Deport Any Chinese-Americans Who Won’t Sign Loyalty Oaths", etc. would be met with cheers by those of our population who ARE racist. And sexist. And homophobic.
